Allahabad High Court Dismisses Criminal Case Against Students Over Namaz at Restricted Site

The Allahabad High Court has quashed criminal proceedings against two students from Sant Kabir Nagar who were charged for offering namaz at a restricted place. Justice Saurabh Srivastava delivered the ruling on February 17, while advising the students to adhere to instructions issued by the local administration in the interest of societal harmony.

The two students faced charges under sections related to being members of an unlawful assembly and disobedience to orders duly promulgated by public servants. A Sant Kabir Nagar court had issued a summoning order against them in May 2019, initiating the legal proceedings.

During the hearings, the students' legal counsel argued that the accused had no prior criminal history and were implicated solely due to restrictions on offering namaz at a specific location. The counsel emphasized that one of the students was preparing for competitive examinations, and involving him in what was described as a "petty offence" could negatively impact his future prospects.

Opposing the plea, the government counsel contended that certain places had been officially notified as non-permissible for offering namaz to ensure law and order. The counsel asserted that the two students chose to offer prayers at these locations in direct violation of the established instructions.

The court acknowledged that in a democratic and secular framework, citizens are guaranteed the right to follow their faith and beliefs according to their own rituals. However, it noted that considering society's mixed culture, a certain standard and the directions issued by the local administration must be followed by all individuals.

"Such compliance is in the larger interest of society for maintaining law and order as well as peace and harmony," the court observed. It further stated that implicating the students solely based on their intention to offer namaz at a place not permitted by the administration was unjustified and could hamper their future.

Ultimately, the court quashed the criminal proceedings, providing relief to the students while reinforcing the importance of balancing religious freedoms with administrative regulations for communal harmony.
