Bombay High Court Directs Kolhapur District Court to Submit CCTV Footage in Lawyer Assault Case

The Bombay High Court's Kolhapur bench has issued a significant directive in response to an alleged assault on a lawyer within court premises. On Monday, the bench ordered the Kolhapur district and sessions court administration to submit CCTV footage capturing the incident that occurred on March 7. The footage must be provided in a pen drive by March 11, when the matter is scheduled for its next hearing.

Legal Bodies File PIL Seeking Enhanced Security Measures

The bench, comprising Justice Madhav Jamdar and Justice Pravin Patil, was hearing a Public Interest Litigation (PIL) filed by multiple lawyers' associations. The Kolhapur district bar association (KDBA) joined forces with three other legal bodies to petition for improved police protection and security in and around the district court premises. This legal action was prompted by the alleged assault, which sparked a protest by lawyers on Monday demanding the arrest of the litigant involved.

The petitioners in this case include:

  • Kolhapur District Bar Association (KDBA)
  • Kolhapur High Court Bench Action Committee
  • High Court Bar Association Kolhapur Circuit Bench
  • Advocate's Association of Western India Kolhapur Bench (Proposed)

The respondents named in the PIL are key state officials, including the chief secretary, principal secretary to the home department, director general of police, Kolhapur superintendent of police (SP), district and sessions judge, and the inspector in-charge of Shahupuri police station.

Advocate Highlights Systemic Failures in Lawyer Protection

Advocate Swaroop Karade, representing the petitioners, articulated serious concerns about the state's failure to protect legal professionals. "The lawyer who was attacked was performing her professional duty, and the government machinery failed to provide appropriate security to her," Karade stated. He emphasized that the PIL addresses critical issues such as inadequate security within court premises, delayed FIR registration, and the absence of a comprehensive legal framework for advocate protection in Maharashtra.

Kolhapur SP Yogeshkumar Gupta appeared before the bench during the hearing, which commenced around 4 PM on Monday. The bench directed Gupta to conduct a thorough review of security arrangements at the district court and implement measures to ensure adequate protection for lawyers and court officers.

Details of the Alleged Assault Incident

The incident in question unfolded around 4 PM on March 7, following a divorce petition hearing. An estranged couple engaged in a heated argument outside the courtroom, prompting intervention from their lawyer. The lawyer, who is representing the husband in the divorce case while his lawyer-wife handles the matter, advised the couple to refrain from quarreling on court premises.

This intervention reportedly infuriated the litigant woman, leading to an alleged physical assault where she slapped and verbally abused the lawyer. The incident has raised significant concerns about safety protocols within judicial complexes and the vulnerability of legal practitioners while performing their duties.

The Bombay High Court's intervention underscores the judiciary's commitment to addressing security lapses and ensuring a safe environment for all court stakeholders. The upcoming submission of CCTV footage is expected to provide crucial evidence as the legal proceedings advance.
