High Court Overturns Transfer Order for PSI Scam Accused RD Patil
The Kalaburagi bench of the Karnataka High Court has quashed a district court order that had authorized the transfer of Rudragouda Patil, also known as RD Patil, an accused in the PSI recruitment scam, from Kalaburagi central jail to Mysuru Central Prison. The high court has issued a directive for Patil to be promptly returned to Kalaburagi central jail, making his repatriation imminent.
Background of the Case and Initial Transfer
Rudragouda Patil has been held in judicial custody at Kalaburagi central jail since November 11, 2023, facing more than 20 criminal cases across Karnataka. On January 27, 2026, the Kalaburagi principal district and sessions court approved his transfer to Mysuru Central Prison, citing security concerns. This decision was based on reports of disputes between Patil and jail officials, which raised alarms about potential risks. The transfer was executed the following day, moving Patil to the Mysuru facility.
Legal Challenge and High Court Proceedings
The transfer order was challenged by Patil's wife, Shobha Patil, who filed a writ petition before the high court. Her legal counsel argued that the district court had permitted the transfer without granting Patil an opportunity to be heard and without providing valid justifications. This was contended to be a violation of the principles of natural justice, which require fair procedures in legal matters.
During the proceedings, the state government defended the transfer on security grounds but conceded that Patil had not been given a chance to present his case before the order was issued. After hearing the petition, a bench led by Justice S Vishwajith Shetty observed that the district court had failed to record adequate reasons for the transfer and had not allowed the undertrial to object to it.
