A family court in Jaipur has ruled in favor of a London-based father, granting him the right to interact with his three-and-a-half-year-old daughter through video conferencing twice a month. The decision comes after a legal dispute regarding access to the child, who was born during the parents' past live-in relationship.
Court's Order and Conditions
The presiding officer of court number four, Pawan Kumar Garg, delivered the ruling, stipulating that the father may connect with his daughter via video calls on the third and fourth Sundays of each month from 11 a.m. to 12 noon. Additionally, the court has mandated that the mother provide the father with monthly updates concerning their daughter's education and health.
Background of the Case
Advocate Sunil Sharma, representing the father, explained that the couple met in Goa in 2022 during the father's visit from London. Their relationship was initially cordial, and they welcomed their daughter on December 16, 2022. However, conflicts eventually arose, leading to strained relations. The father claimed that the mother began to restrict his access to the child, denying him opportunities to meet or communicate with her despite his repeated requests.
Father's Concerns
In his petition to the family court, the father expressed concerns that depriving the child of her father's affection could have detrimental effects on her emotional and mental development. He emphasized the importance of maintaining a father-child connection, arguing that his role as a parent extends beyond biological ties.
Mother's Response
The mother contested the father's claims, labeling his petition as baseless and asserting that he intended to take the child abroad. However, after thorough deliberation and consideration of both parties' arguments, the court concluded that a child should not be deprived of the love and affection of both parents, reinforcing the significance of nurturing emotional bonds within families.
