Jalgaon Court Directs FIR Against Farmers and Lawyers in Compensation Fraud Case
The court of the joint civil judge, senior division, in Jalgaon has issued a significant order directing the registration of a First Information Report (FIR) against multiple farmers and their legal representatives. The case centers around allegations of document fabrication aimed at securing increased compensation for land that was acquired for a minor irrigation tank project more than a decade ago.
Background of the Land Acquisition Dispute
This legal controversy traces back to 2012 when the Special Land Acquisition Officer (SLAO) acquired land from residents of Pachora taluka in Jalgaon district for the development of a minor irrigation tank. At that time, the compensation was officially announced and subsequently disbursed to the affected landowners according to established procedures.
According to a senior official from the land acquisition department at the Jalgaon collectorate, the Land Acquisition Act of 1894 provides a specific mechanism for landowners who are dissatisfied with the compensation awarded. "Under the provisions of the Act, landowners can formally apply to the SLAO seeking enhancement of their compensation," the official explained. "The officer would then make a formal 'reference' to the appropriate court for adjudication of the matter."
Discovery of Alleged Document Forgery
In the present case, however, the court discovered serious irregularities in the documentation presented before it. The farmers had approached the court claiming that the SLAO had failed to grant them just compensation and that a reference had been made seeking enhancement, which the court subsequently allowed based on the documents submitted.
"The court found that the purported reference letter was completely fabricated and that numerous documents submitted as evidence were forged," the senior official stated. "This discovery prompted the court to take serious action against those involved in what appears to be a coordinated attempt to defraud the compensation system."
Administration's Clarification and Court's Response
After the court awarded enhanced compensation based on the forged documents, the SLAO brought crucial information to the court's attention. The administration clarified that no such reference had ever been made by their office regarding these particular farmers' compensation claims. Furthermore, officials confirmed that none of the farmers in question had approached the department for enhanced compensation during the relevant period when such applications would have been valid.
The January 19 order from the Jalgaon court represents a firm judicial response to these findings. The court has specifically directed the registration of an FIR against:
- The farmers involved in the alleged fraud
- Their legal representatives who presented the forged documents
- Any other persons who may have assisted in manipulating the documentation
Additional Legal Action Authorized
In a further development, the court has authorized the superintendent of the court to file separate complaints before the jurisdictional magistrate against the farmers and their lawyers. This action will proceed under Section 215(1)(b) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which deals with offenses related to false evidence and document forgery in judicial proceedings.
