Jammu and Kashmir High Court Grants Permission for Hotel Eviction Petitions Withdrawal

The Jammu and Kashmir High Court has authorized the withdrawal of petitions filed by hotels confronting eviction from their properties in the renowned tourist destination of Gulmarg. This decision came after the Union Territory government provided assurances to the court that it remains open to achieving a fair and viable resolution regarding the lease expiry issues.

Government Assurance and Legal Proceedings

During the court proceedings, Additional Advocate General Mohsin Qadri conveyed that if the petitioners submit formal representations within a two-week timeframe, the competent authority will conduct hearings before making any final decisions. Subsequently, each petitioner will receive communication regarding the outcome.

Advocate ZA Shah, representing the hoteliers, then requested permission to withdraw the pleas to initially approach the government directly. Qadri later informed The Times of India that the petitioners are no longer seeking adjudication from the High Court and have instead limited their relief to having their representations considered by the government.

Background: Land Grant Rules and Lease Expirations

The Lieutenant Governor administration introduced the J&K Land Grant Rules in 2022 under the J&K Reorganisation Act of 2019. These regulations prohibit lease extensions after expiry and permit properties to be auctioned through open bidding to any Indian citizen.

Prior to the abrogation of Articles 370 and 35A on August 5, 2019, land leases in Jammu and Kashmir were restricted exclusively to permanent residents of the region. Under the newly implemented rules, leases for 55 out of 59 hotels in Gulmarg have expired, leading numerous hoteliers facing potential eviction to seek recourse through the High Court.

Notable Case: Nedous Hotel Seizure

While the court was still hearing the case, the Union Territory administration took control of the historic Nedous Hotel on August 3 of the previous year. This marked the first property to be sealed after the Gulmarg Development Authority issued a 24-hour eviction notice, despite the hotel's lease having expired as far back as 1985.

Political Response and Proposed Legislation

In a related development, National Conference spokesperson Tanvir Sadiq announced that the party intends to introduce a Land Grants Bill in the assembly next week. This proposed legislation aims to reverse the 2022 J&K Land Grant Rules, reflecting ongoing political debates surrounding land ownership and lease policies in the region.

The situation highlights the complex interplay between legal frameworks, tourism infrastructure, and political dynamics in Jammu and Kashmir following significant constitutional changes.
