Coimbatore Judge Conducts Unprecedented Hearing in Van for Bedridden Litigant
In a remarkable display of judicial accommodation, a judge in the Coimbatore district court held a hearing for a 42-year-old bedridden man inside a specially designed van used for transporting disabled individuals. The extraordinary session took place on Wednesday, with Judge S Maharajan stepping out of the courtroom to conduct proceedings within the vehicle where the litigant, G S Loganathan, was positioned.
From Accident to Advocacy: Loganathan's Journey
G S Loganathan, a resident of Sundarapuram in Coimbatore, suffered a life-altering road accident in 2006 while working at a hotel in Jaipur, Rajasthan. The collision resulted in a severe spinal fracture that left him partially disabled, with loss of function in all body parts below his neck. Following extensive treatment across multiple hospitals, Loganathan demonstrated remarkable resilience, gradually regaining his ability to walk after twelve years of rehabilitation.
By 2018, he had progressed to walking with the assistance of a walking frame. During his recovery, Loganathan channeled his experiences into writing, ultimately publishing his autobiography in 2021. His literary achievements caught the attention of a well-known rejuvenation home in Coimbatore, which approached him with an offer for physiotherapy treatment.
The Incident That Led to Complete Immobility
The rejuvenation home proposed that Loganathan's presence would inspire other patients, given his continued writing despite his partial disability. However, during a physiotherapy session conducted by two trainees at the facility, Loganathan suffered a fracture in his leg due to what he alleges was their negligence. This incident rendered him completely bedridden, a condition he maintains was exacerbated by the home's management allegedly ignoring his deteriorating state and failing to provide adequate care.
Legal Battle and Supreme Court Intervention
Following the incident, Loganathan filed a petition with the Supreme Court detailing his situation and the alleged negligence. The apex court directed the Tamil Nadu government to take necessary action in response to his claims. This directive led to the filing of a formal case in the court of the principal district munsif in Coimbatore.
Loganathan arrived at the court complex in the specially designed van, prompting Judge Maharajan to adapt the proceedings to accommodate his condition. The judge conducted the hearing inside the vehicle, ensuring the litigant could participate without requiring physical transfer to the courtroom.
Compensation and Systemic Change Sought
In his petition, Loganathan is seeking compensation for the alleged negligence that resulted in his current bedridden state.
