Justice Yashwant Varma Resigns Amid Cash Recovery Scandal and Impeachment Proceedings
Justice Yashwant Varma of the Allahabad High Court has formally submitted his resignation to President Droupadi Murmu on Friday, marking a dramatic development in a case involving allegations of unaccounted cash recovery and impeachment proceedings initiated against him in Parliament.
Background of the Controversy
The controversy centers on allegations that substantial amounts of unaccounted cash were discovered after a fire broke out in a storeroom at Justice Varma's official residence on March 14. Fire tenders responding to the blaze reportedly found significant cash amounts at the premises, though the judge was not present at the residence at the time of the incident.
This discovery triggered an immediate in-house inquiry led by the Supreme Court, which subsequently recommended further action. Justice Varma had previously been transferred from the Delhi High Court to the Allahabad High Court after these allegations surfaced. He had taken his oath on April 5 last year before being placed under the Supreme Court-led investigation.
Impeachment Proceedings and Legal Challenges
The findings from the Supreme Court's in-house inquiry led to the initiation of impeachment proceedings in Parliament. Lok Sabha Speaker Om Birla accepted a motion signed by 146 Members of Parliament and established a three-member committee to thoroughly investigate the allegations against Justice Varma.
The investigative panel included:
- Justice Amit Kumar
- Justice Maninder Mohan Srivastava
- B B Acharya
During earlier hearings, the Supreme Court raised questions about why Justice Varma did not challenge the in-house inquiry process at the outset, instead participating in it before raising constitutional objections later. Justice Varma had argued that the proceedings were unconstitutional and challenged both the inquiry findings and the recommendation made by then Chief Justice of India Sanjiv Khanna to initiate impeachment.
Resignation Amid Mounting Pressure
The resignation comes as Justice Varma faced mounting pressure from both the judicial inquiry and parliamentary proceedings. The case has drawn significant attention to judicial accountability and the mechanisms for addressing allegations against sitting judges. The timing of the resignation, submitted directly to the President, suggests a strategic move amid the ongoing impeachment process that could have led to his removal from office.
This development represents one of the most significant judicial controversies in recent years, highlighting the complex interplay between judicial independence and accountability mechanisms. The resignation effectively ends Justice Varma's tenure on the bench, though the broader implications for judicial oversight and reform continue to be debated within legal circles.
