The Additional District and Sessions Judge of Kanpur Nagar, Nisha Srivastava, on Wednesday dismissed the anticipatory bail application of Mayank Bhardwaj, a resident of Sikkim, in a case involving forged educational degrees.
Prosecution's Arguments
Opposing the bail plea, Additional District Government Counsel Vinod Tripathi argued that Mayank Bhardwaj and a co-accused in the scam had been in regular contact via mobile phone. According to the prosecution, Mayank traveled to Ghaziabad to meet Shailendra, another accused, and sent marksheets of Asian International University, Manipur, through a courier service.
Call Detail Records Evidence
The mobile Call Detail Records (CDR) revealed that co-accused Shailendra Kumar and Mayank Bhardwaj exchanged 625 incoming calls and 662 outgoing calls between February 1, 2024, and February 13, 2026. The seized marksheets were found to be forged, strengthening the case against them.
The Additional District Government Counsel further stated that the agents of this gang are spread across India. Granting bail to the accused would not only lead to the destruction of evidence but also hamper the ongoing investigation.
Court's Decision
After hearing the arguments, the judge dismissed the anticipatory bail application, citing the seriousness of the offense and the potential risk of evidence tampering.
