Kanpur: Bail Application Dismissed in Fake Degree Case
Additional District and Sessions Judge, Kanpur Nagar, Nisha Srivastava, on Wednesday dismissed the anticipatory bail application of accused Nagendra Mani Tripathi, allegedly a member of a gang involved in creating forged marksheets and certificates. The Kidwai Nagar police had uncovered the gang, arresting Tripathi and others on February 19, 2026.
Prosecution's Arguments
Additional District Government Counsel Vinod Tripathi opposed the bail, arguing that forged degrees, marksheets, and other illicit materials were recovered from the accused at the time of his arrest. He stated that these individuals were engaged in manufacturing and selling fake degrees across the country. A previous regular bail application had been dismissed by the same court.
The ADGC further noted that the Allahabad High Court had quashed proceedings in a writ petition solely on procedural grounds—the arrest memo and remand order were not in accordance with the law—and ordered Tripathi's release. However, the High Court made no comments on the merits of the case, nor did it stay arrest or make observations regarding the ongoing investigation.
The ADGC submitted that Tripathi was continuously attempting to influence evidence and failed to appear despite being contacted by the investigating officer. Granting anticipatory bail would compromise the investigation irreparably.
Court's Observation
The court deemed the matter serious, observing that the issue of fake degrees is rampant across the country. Under these circumstances, there were no grounds to grant anticipatory bail, and the application was rejected.
Accused's Defense
In his anticipatory bail application, Nagendra Mani submitted that he was innocent and had not committed any crime. He claimed that on February 17, 2026, around 10:30 pm, he was walking with his son near George Town, Prayagraj, when police picked him up and showed his arrest from Kidwai Nagar, Kanpur. Nothing was recovered from his possession. He had been released from jail in compliance with an Allahabad High Court order. He filed this anticipatory bail application as police were attempting to arrest him again.
