Legal Battle Erupts Over Kanpur Lamborghini Crash Arrest

The lawyer representing Shivam Mishra, the accused in the high-profile Lamborghini car accident case in Kanpur, has vehemently claimed that his client has been wrongfully arrested by the police. Narendra Kumar Yadav, the legal counsel, stated on Thursday that Mishra was not driving the luxury vehicle at the time of the crash, which occurred on February 8 near Jhula Park Crossing.

Conflicting Accounts Emerge in Investigation

"He (Shivam Mishra) has been wrongly arrested by the police. He was not driving the car," Yadav told ANI, emphasizing that the actual driver was responsible for the incident. This assertion directly contradicts the official police position, as confirmed by DCP Central Kanpur Atul Kumar Srivastava, who stated that the investigation has conclusively established Mishra was operating the vehicle during the accident.

"We got information that he (Shivam Mishra) is in Kanpur. Five teams were formed, and we have arrested him, and he has been presented in court. In the investigation, it has been found that during the accident, Shivam Mishra was driving the car," Srivastava explained to ANI. The arrest came four days after the Lamborghini rammed into multiple vehicles, including an autorickshaw and a bullet motorcycle, before crashing into a pole, leaving one person injured.

Driver's Testimony Adds Complexity to Case

Adding a layer of complexity to the situation, the driver of the Lamborghini, identified as Mohan, admitted on Wednesday that he was driving the vehicle at the time of the accident. According to his testimony, Mishra was sitting beside him and experienced a medical seizure during the incident.

"...Yes. He (Shivam Mishra) had a seizure. Suddenly, his arms and legs started shaking, and he fell on me. I was there (at the spot). I was there on the day the accident happened. The bouncer pulled me out (of the car)," Mohan stated when questioned about the events. Yadav further elaborated that the driver had submitted an affidavit accepting responsibility for the accident and that compensation had been settled with the injured party.

Police Maintain Position Based on Evidence

Despite these claims, Kanpur Police Commissioner Raghubir Lal reiterated that Mishra is considered the driver based on substantial evidence collected during the investigation. "When Shivam's name comes up in our investigation, it means that we are satisfied that the driver was Shivam, so they can keep saying anything. We have CCTV footage. His name has been included in the FIR," Lal asserted.

The case has been registered under multiple sections of the Bharatiya Nyaya Sanhita (BNS), 2023, including:

  • Section 281
  • Section 125(a)
  • Section 125(b)
  • Section 324(4)

Sub-Inspector Dinesh Kumar has been assigned to lead the ongoing investigation. Eyewitnesses at the scene had previously reported that the Lamborghini was being driven at excessive speed when it caused the multi-vehicle collision, heightening public concern about road safety involving high-performance vehicles.
