The Delhi High Court is currently hearing a high-stakes legal battle over the inheritance of late businessman Sunjay Kapur's massive estate, estimated at a staggering ₹30,000 crore. The dispute pits Kapur's third wife, Priya Kapur, against his children from his previous marriage to Bollywood actress Karisma Kapoor.
Healthy Tradition or Suspicious Will?
During Thursday's hearing, Priya Kapur's legal team made a significant argument defending the will that leaves everything to her. Senior advocate Rajiv Nayar representing Priya Kapur stated, "There is nothing suspicious about a husband giving everything in his assets to his wife. As is the case in my father-in-law's 'will' where everything was given to his wife. It is a healthy tradition which perhaps has been maintained."
The counsel emphasized that this pattern was established when Sunjay's father left all his assets to his wife, Rani Kapur. This argument forms the cornerstone of Priya's defense against allegations of will forgery raised by Karisma Kapoor's children.
Children Challenge Will Authenticity
Samaira Kapur and her brother Kiaan, represented by their mother Karisma Kapoor as legal guardian, have filed a case challenging the will's validity. They are seeking a share in their late father's personal assets and have alleged forgery in the document presented by Priya Kapur.
The case names multiple respondents including Priya Kapur, her minor son, Sunjay's mother Rani Kapur, and Shradha Suri Marwah - the purported executor of a Will dated March 21, 2025. Senior Advocate Akhil Sibal, representing the minor, argued that the entire case against his client was based on "speculation and guess work."
Will Preparation Details Revealed
New details emerged about the will's preparation during the court proceedings. Advocate Nayar revealed that a printout of the will was shown to Sunjay Kapur on February 10, 2025, and the businessman himself suggested changes to the draft.
The final modifications were made on March 17, 2025, while Sunjay was in Goa. Notably, Priya Kapur's counsel disclosed that both Sunjay and Priya prepared their wills together on the same day, describing this as customary for married couples.
Addressing questions about document errors, Nayar explained that spelling mistakes occurred because the template was based on Rani Kapur's will. "I was reluctant to show it because of confidentiality but the template is based on my mother in law's (Rani Kapur) will... there are spelling errors because of the template it was taken from," he told the court.
The case, presided over by Justice Jyoti Singh, continues to unfold with significant financial and familial implications. Sunjay Kapur, the former chairman of auto parts manufacturer Sona Comstar, died in June while playing polo in London. He was married to Karisma Kapoor from 2003 to 2016 before marrying Priya in 2017.
