Karnataka High Court Intervenes in Heartwarming Adoption Case
In a significant development that brings renewed hope to a compassionate couple from Shivamogga, the Karnataka High Court has stepped in to facilitate their long-standing battle to legally adopt a child they have lovingly raised for nearly ten years. The court's directive marks a pivotal moment in a case that underscores the complexities of adoption procedures versus the paramount interest of a child's welfare.
A Decade of Care and Legal Hurdles
The petitioners, a couple who tragically lost their own disabled infant twelve years ago when it was just four months old, took custody of an abandoned baby boy on June 10, 2016. The child had been left at the Gavi Siddheshwara Swami mutt merely three days after birth, and the seer of the mutt entrusted the infant to their care. Since then, the couple has raised the boy as their own, with him now studying in the fourth standard, forming an unbreakable familial bond.
However, their journey to formalize this relationship through adoption hit a roadblock in 2017 when the Child Welfare Committee (CWC) in Shivamogga initiated proceedings. The couple challenged these actions, arguing that denying them adoption rights would be inhumane, given their decade of dedicated parenting and the child's well-being.
Court's Emphasis on Child's Welfare
Justice DK Singh, while disposing of the petition, delivered a poignant observation. "The court is of the opinion that the paramount interest of the child's welfare, care and protection would be secured in the hands of the petitioners who looked after the child as their own," he stated. The judge acknowledged that procedural and legal oversights might have prevented the couple from approaching the committee as mandated under the Juvenile Justice (Care and Protection of Children) Model Rules, 2016.
To address this, the court has issued clear instructions:
- The petitioners must produce the child before the CWC in Bengaluru on March 10.
- The committee is to conduct an inquiry to assess whether the child's interest and welfare are secured in the petitioners' custody.
- During this inquiry, the child will remain in the custody of the couple, ensuring stability and continuity of care.
Path Forward for Adoption
Once the CWC completes its inquiry, the process for adoption is set to move forward swiftly. The court emphasized that the petitioners' application for adoption should be processed promptly. If found eligible, the child should be formally given to them in adoption, recognizing their years of nurturing and commitment.
Furthermore, the Central Adoption Resource Authority (CARA) in Bengaluru has been directed to expedite the application post-inquiry, ensuring no unnecessary delays in granting the couple legal parental rights.
