Ludhiana Court Delivers Strong Verdict in Major Drug Trafficking Case
In a significant ruling against narcotics trafficking, a Ludhiana court has handed down ten-year rigorous imprisonment sentences to two convicted drug peddlers. Special court judge Dr. Gurpreet Kaur pronounced the verdict after the accused were found in possession of a massive quantity of intoxicant tablets.
Substantial Fines Imposed with Additional Penalty Clause
The court imposed a substantial fine of Rs 1 lakh on each convict. Judge Kaur specified that failure to pay this fine would result in an additional year of rigorous imprisonment for each defendant, underscoring the seriousness with which the court views drug-related offenses.
Case Origins: September 2022 Police Operation
The case traces back to September 9, 2022, when Tibba police registered a case under the stringent Narcotic Drugs and Psychotropic Substances (NDPS) Act. The accused were identified as Toshif Alam, originally from Bihar but residing on Tibba Road, and Kuldeep Singh of Gopal Nagar.
According to prosecution details presented in court, Assistant Sub-Inspector Ranjit Singh and his police team were conducting routine checks near the Ganda Nala bridge in Geeta Nagar when they observed Alam riding a motorcycle while carrying a conspicuously heavy plastic bag.
Dramatic Apprehension and Initial Recovery
Upon noticing the police presence, Alam attempted an abrupt U-turn but lost control of his motorcycle, causing the bag to fall and scatter its contents. Despite attempting to flee the scene, Alam was quickly apprehended by the alert police team.
An immediate search revealed the bag contained 37,600 intoxicant tablets. Police officials requested four to five passersby to serve as independent witnesses to the recovery, but all declined to participate in the legal proceedings.
Interrogation Leads to Additional Arrests and Recoveries
During subsequent interrogation, Alam identified Kuldeep Singh as his supplier. This revelation prompted police to nominate Singh and another individual named Prince in the formal case documentation.
On September 11, 2022, authorities arrested Kuldeep Singh using production warrants from Central Jail in Ludhiana. A thorough search of Singh's residence yielded an additional 5,000 tablets discovered in two separate bags within his bedroom, bringing the total recovery to 42,600 tablets.
Legal Proceedings and Defense Claims
While police filed a chargesheet against Alam and Singh, the third accused, Prince, remains at large and continues to evade authorities. During the trial proceedings, both convicted individuals claimed they had been falsely implicated by police and alleged that the drug recovery had been planted against them.
Court Dismisses Defense Arguments
The court systematically dismissed these defense claims, noting that the prosecution had successfully established both Alam and Singh were in "conscious possession" of substantial quantities of intoxicant tablets without valid permits or documentation.
Judge Kaur observed it was highly improbable that police officials would plant such commercial quantities of drugs without any evidence of prior enmity or motive against the accused. Regarding the absence of independent witnesses, the court acknowledged this common challenge in drug cases, noting that citizens frequently hesitate to participate in legal proceedings due to legitimate concerns about potential harassment or retaliation.
The judgment affirmed that official testimony maintains credibility even without corroboration from private citizens, particularly when supported by consistent evidence and proper procedural documentation. This ruling reinforces the judiciary's commitment to combating the narcotics trade through stringent legal measures and substantial penalties for offenders.
