Ludhiana Court Imposes Life Sentence in Gruesome Murder Case Over Unpaid Loan
A local court in Ludhiana has delivered a stern verdict, sentencing a man to life imprisonment for the brutal murder of a vegetable vendor to whom he owed a substantial amount of money. The court of Additional Sessions Judge Barinder Singh Ramana also levied a fine of Rs 1 lakh on the convict, identified as Shankar Sharma, a resident of Chotta Khanna.
Background of the Case and Police Investigation
Shankar Sharma had been formally charged by the Khanna City-2 police station on August 17, 2021, under Section 302 of the Indian Penal Code for the murder of Mithlesh Rai. According to the prosecution's account, the case unfolded from a complaint filed by Renu Devi, the wife of the deceased.
In her statement to the authorities, Renu Devi detailed that her husband had lent Rs 2,50,000 to Shankar Sharma to facilitate the purchase of a plot of land. She emphasized that the accused had consistently avoided repaying the loan despite numerous demands from the family.
Fateful Night and Discovery of the Crime
The tragic incident occurred on the night of August 16, 2021, around 10 PM. Renu Devi and her husband were stationed near Home City Colony with their vegetable cart when Shankar Sharma arrived on his scooter. The accused informed Mithlesh Rai that he had arranged the loan amount and requested him to accompany him so the money could be handed over.
Expressing suspicion, Renu Devi followed them at a distance. She recounted to the police that after a short while, she observed the accused leading her husband toward Gurcharan Avenue and into the vicinity of Karam Colony, an area she described as desolate and poorly lit.
From afar, she heard the loud, distressing cries of her husband. Overcome by fear due to the darkness, she returned home. The following morning, around 8 AM, while searching for her husband near Karam Colony, she discovered his lifeless body lying beside the road, bearing multiple wounds.
Legal Proceedings and Defense Arguments
Based on Renu Devi's harrowing account, the police promptly registered a murder case against Shankar Sharma and subsequently apprehended him. After a thorough investigation, a chargesheet was filed in court, leading to a trial.
During the proceedings, Shankar Sharma maintained his innocence, claiming he had been falsely implicated in the crime. His defense team argued that his clothes had been deliberately stained with the blood of the deceased to frame him.
Court's Reasoning and Final Judgment
The court meticulously examined the evidence and rejected the defense's contention. It observed that if the intention had been to falsely implicate the accused, the hammer recovered based on his disclosure statement could also have been tampered with to bear bloodstains, which was not the case.
Furthermore, the court noted that the accused never disputed knowing the deceased. It held that the evidence on record conclusively established that Shankar Sharma and Mithlesh Rai were acquainted and that the accused had a clear motive, stemming from the unpaid debt.
The court also referenced Renu Devi's statement, which indicated that an argument had ensued regarding the loan amount prior to the incident. Crucially, the presence of the deceased's bloodstains on the clothes worn by Shankar Sharma on the day of the murder was deemed strong, incriminating evidence that the accused failed to rebut.
Concluding that all circumstances pointed unequivocally to his involvement, the court convicted Shankar Sharma for the murder of Mithlesh Rai, imposing a life sentence and a significant fine, thereby delivering justice in this grave matter.
