Madras High Court Establishes Procedure for Kalaimagal Sabha Land Auction

The Madras High Court has laid down a detailed procedure to carry out the auction of four beleaguered land parcels belonging to Kalaimagal Sabha in Coimbatore and Tiruvaur, which is scheduled for April 2. This decision comes after the court reviewed a joint report submitted by the special officer of Kalaimagal Sabha and a one-man commission, which outlined the auction process.

Court Directives on Valuation and Notices

A division bench comprising Justice Anita Sumanth and Justice Sunder Mohan has instructed the commission to nominate two independent valuers for the valuation of lands located in specific survey numbers of Bilichi village, Coimbatore. This move follows a complaint by senior counsel V R Kamalanathan and G Mohana Krishnan, who argued that the properties had been undervalued, prompting the court to ensure a fair and transparent auction process.

The court has also directed special government pleader Selvendran to instruct the tahsildar of Mettupalayam to issue notices to the joint pattadars in lands situated in Mooduthurai and Bilichi. Additionally, the tahsildar is required to decide whether names should be removed from the pattas, with compliance mandated within four weeks and a report to be submitted to the court.

Auction Details and Timeline

According to the joint report, the e-auction is scheduled for April 2, with the successful bidder to be announced on the same day. Although the initial auction notice indicated that bids would be accepted until March 27, the court has confirmed the April 2 date for the auction proceedings. The case has been adjourned to April 2 for further review and to monitor compliance with the court's directives.

This legal intervention aims to address concerns over property valuation and ensure a smooth auction process for the Kalaimagal Sabha lands, which have been subject to legal scrutiny. The court's proactive measures highlight its commitment to upholding justice and transparency in property disputes within the region.
