Madras High Court Implements Interim Stay on Boat Services in Thamirabarani River

In a significant ruling, the Madras High Court has issued an interim stay order to halt the operation of boat services in the Thamirabarani river located in Kanyakumari district. This decision was delivered on Friday by a division bench comprising Justice N Sathish Kumar and Justice M Jothiraman. The bench was presiding over a public interest litigation (PIL) filed by T Prabhu, a local resident, who raised serious safety concerns regarding the unauthorized and hazardous boat activities in the river.

Background of the Case and Petitioner's Plight

The petitioner, T Prabhu, has been using a coracle to cross the Thamirabarani river since 2019. His daily commute involves traveling from his residence in Kadaiyal to his agricultural land in Thirparappu. Prabhu relies on this traditional boat not only for personal transportation but also for transporting agricultural produce such as coconuts, bananas, and tapioca back to his home. He emphasized that operating a coracle for livelihood purposes does not require any formal licence or permission from authorities, as it is a personal and essential means of sustenance.

Discovery of Illegal and Unsafe Boat Operations

The situation escalated in January 2026 when Prabhu, while crossing the river in his coracle with friends, observed two overcrowded boats carrying tourists. One boat was packed with 35 tourists, and another had 12 tourists on board. Alarmingly, none of the tourists were provided with life jackets, posing a severe risk to their safety. Upon inquiry with local authorities in Kadaiyal and Thirparappu, Prabhu learned that these boats were operated by a private individual without obtaining any necessary licences or approvals from regulatory bodies.

Legal Action and Court's Response

Concerned about the potential dangers, Prabhu submitted a formal representation to the authorities, urging them to stop the illegal boat services and take action against the private operator. However, when no steps were taken to address his complaints, he was compelled to approach the Madras High Court through a PIL. The court, recognizing the gravity of the safety issues and the lack of regulatory compliance, promptly issued an interim stay to restrain the boat services until further notice.

Implications and Next Steps

This interim order highlights the court's commitment to public safety and environmental protection in the Thamirabarani river region. The stay will remain in effect as the case proceeds, with the bench likely to examine the legality of the boat operations and the adequacy of safety measures. This ruling serves as a reminder of the importance of adhering to licensing requirements and ensuring tourist safety in water-based activities. The case underscores the role of judicial intervention in addressing community concerns when administrative actions fall short.
