The Madras High Court has taken a significant step in a political symbol dispute, issuing a directive to the Election Commission of India (ECI) to respond to a petition filed by Pattali Makkal Katchi (PMK) founder S Ramadoss. The plea challenges a communication from the ECI that allotted the party's iconic 'mango' symbol to a faction led by his son, Anbumani Ramadoss.

Court Admits Plea and Sets Timeline for Response

Admitting the plea on Monday, the first bench comprising Chief Justice Manindra Mohan Shrivastava and Justice G Arul Murugan directed the ECI to file its counter affidavit within three weeks. This move underscores the court's urgency in addressing the matter, particularly with upcoming elections in mind.

Ramadoss's Arguments and Allegations

Representing S Ramadoss, advocate K Arul presented a compelling case before the court. He argued that the ECI inadvertently sent the communication allotting the 'mango' symbol to the PMK to the address of Anbumani, who served as the former president of the party. "We requested the commission to send the communication to the address of the current president and founder, S Ramadoss," Arul stated, adding, "Anbumani is not even a member of the PMK at present."

Ramadoss further elaborated that his son, Anbumani, was appointed as president for a fixed term from May 28, 2022, to May 2025, a detail that was duly communicated to the ECI. He emphasized that there was no provision for extension of this tenure. According to Ramadoss, after Anbumani's term expired, forged documents were created and submitted to the ECI, leading to the disputed symbol allotment.

Court's Stance on Anbumani's Involvement

During the proceedings, senior advocate N L Rajah attempted to make submissions on behalf of Anbumani. However, the court firmly refused to grant him an audience, pointing out that Anbumani was not a party to the litigation. The bench clarified, "How can we hear you (Anbumani)? You are not a party to the litigation. If you wish to participate, you must file an appropriate petition to be impleaded." This decision highlights the court's adherence to procedural norms in such disputes.

Ramadoss's Demands and Implications

S Ramadoss has sought the court's intervention to direct the ECI to issue a fresh communication allotting the 'mango' symbol to the PMK under his leadership. He aims to be recognized as the present president for the purpose of the upcoming polls, asserting his authority over the party's symbol and electoral representation.
