In a significant development, the Delhi Police has successfully arrested the primary contractor linked to the unfortunate demise of 25-year-old Kamal Dhyani, who tragically lost his life after falling into an uncovered excavation pit in the Janakpuri area of west Delhi. The accused, identified as Himanshu Gupta, was apprehended from Udaipur in Rajasthan, where he had been evading authorities, as confirmed by Deputy Commissioner of Police (West) Darade Sharad Bhaskar.
Details of the Incident and Investigation Findings
The incident occurred when Dhyani was returning home from his office late at night. Police investigations reveal that he fell into a pit that had been dug just hours earlier on the main road. Although the fall is believed to have happened around midnight on February 6, his body was only discovered approximately eight hours later at 8 am, following an alert from a concerned passerby to the police control room.
Upon arrival at the scene, authorities found Dhyani and his motorcycle inside the pit. A thorough inspection by the police highlighted multiple instances of gross negligence, including:
- Failure to cover the excavation pit on a public thoroughfare
- Absence of adequate safety measures during the digging process
- Lack of proper warning signs or reflective markers around the site
- Insufficient lighting in the vicinity of the hazardous area
Police officials stated unequivocally that the contractors were fully aware that leaving such open pits without necessary precautions could lead to fatal accidents. The inspection clearly indicates that the contractors were aware that leaving open pits on the road without safety measures could result in someone falling and potentially dying, emphasized the investigating team.
Family Account and Legal Proceedings
According to Dhyani's family members, he regularly commuted along the same route to his workplace and was thoroughly familiar with the area. On the fateful day, he had safely traversed the stretch in the morning without incident. In the evening, he had no idea that a pit had been dug there. There were no warnings or proper barricades, lamented his father, highlighting the complete lack of safety protocols.
The police initially registered a case under sections pertaining to culpable homicide. Subsequently, they augmented the charges to include criminal conspiracy, destruction of evidence, and common intention, reflecting the severity of the oversight and subsequent actions.
Evidence Tampering and Additional Arrests
Investigators uncovered that despite being aware of the tragic incident, the suspects allegedly failed to notify the police and instead conspired to conceal the matter. A police source disclosed that one of the accused, Rajesh Kumar Prajapati, purportedly instructed a laborer named Yogesh to cover the site with a green sheet and place barricades near the accident location after the fact. This act is being treated as deliberate tampering with evidence to obstruct the investigation.
Prior to Gupta's arrest, two other individuals had already been taken into custody in connection with the case. The ongoing probe continues to examine the chain of responsibility and accountability for the lapses that led to this preventable tragedy.
