MP High Court Initiates Criminal Contempt Proceedings Against BJP MLA
A division bench of the Madhya Pradesh High Court, led by Chief Justice Sanjeev Sachdeva, has taken a decisive step by ordering criminal contempt proceedings against BJP MLA Sanjay Pathak from Katni. The court's action stems from allegations that the legislator attempted to improperly influence a judge presiding over a sensitive mining case. This case notably involves Pathak's own son and mother, adding a layer of familial and political intrigue to the legal proceedings.
Allegations of Judicial Influence and Case Background
The controversy came to light when Justice Vishal Mishra disclosed in open court on September 1, 2025, that he had received a phone call from Sanjay Pathak regarding the ongoing mining case. Following this revelation, Justice Mishra recused himself from hearing the matter, citing the attempted communication as a clear conflict of interest. Sanjay Pathak, a former state minister often described as a mining baron due to his extensive interests in the sector, now faces serious legal consequences for this alleged interference.
The case itself originated from a complaint filed by Ashutosh Dixit of Katni in January 2025. Dixit accused Pathak's company, M/s Nirmala Minerals, of engaging in widespread illegal mining activities across Sehora town in Jabalpur, Gosalpur, and Katni. Shockingly, the allegations extend to mining operations in areas designated as green belts, which are supposed to be protected environmental zones. Dissatisfied with the lack of action from the Economic Offence Wing (EOW) of the police, Dixit escalated his grievance to the High Court, seeking legal intervention.
Court Proceedings and Interveners' Role
During the court hearings, the EOW informed the bench that Dixit's complaint had been forwarded to the state government's mines and minerals department for necessary action, where it remains pending. Meanwhile, the directors of M/s Nirmala Minerals, including MLA Sanjay Pathak's mother, Nirmala Pathak, and his son, Yash Pathak, applied to join the proceedings as interveners. It was during these hearings that Justice Mishra discovered the connection between Yash Pathak and the phone call from his father, Sanjay Pathak, prompting his recusal.
Ashutosh Dixit subsequently filed a plea requesting legal action against Sanjay Pathak for attempting to influence the judge. Hearing this plea on Thursday, the division bench comprising Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf ordered the initiation of criminal contempt proceedings against the BJP MLA. This move underscores the judiciary's commitment to upholding judicial integrity and preventing external pressures on legal processes.
