Mumbai Sessions Court Rejects Bail in Tragic Child Fatality Case
A sessions court in Mumbai has firmly denied bail to a 41-year-old businessman, Ramesh Jatrara, who stands accused of causing the death of a four-year-old boy in a devastating incident last month. The court's decision, delivered on March 6 with the detailed order made public on March 9, underscores the gravity of the allegations and the ongoing investigation.
The Incident and Initial Proceedings
The tragic event unfolded around 4:30 PM on February 7, 2026, within the parking area of a residential housing society located in Malad East, Mumbai. According to prosecution accounts, Jatrara was operating his SUV in a rash and negligent manner at high speed when he struck the young child. Shockingly, he allegedly fled the scene without offering any medical assistance to the critically injured boy.
Initially, Jatrara was granted bail by a holiday remand court for what were considered bailable offenses. However, his inability to provide the required surety resulted in his continued detention in magisterial custody. During this period, investigators uncovered new evidence that significantly altered the case's trajectory.
Escalation of Charges and Court Observations
The investigation took a serious turn when police recorded a statement from the deceased child's cousin. This individual alleged that Jatrara had previously threatened to kill him following a dispute over parking in the society. Based on this testimony, the investigating officer invoked Section 105 of the Bharatiya Nyaya Sanhita, which pertains to culpable homicide not amounting to murder.
Judge YMH Kharadi, presiding over the case, made several critical observations in the bail rejection order. The court noted that Jatrara had knowledge that children were playing in the parking area and that driving at high speed without due care could lead to fatal consequences. The judge also referenced the cousin's statement about the prior threat, indicating a possible motive beyond mere negligence.
Prosecution and Defense Arguments
The prosecution vehemently opposed bail, arguing that Jatrara demonstrated intention to cause harm to the victim's family members. They submitted that despite knowing children were present, he drove his vehicle with the awareness that such an action could likely cause death. The prosecution further contended that releasing the accused would jeopardize the investigation, as he might tamper with evidence or attempt to flee justice, especially given the profound shock and trauma experienced by the victim's family.
In contrast, defense lawyers portrayed the incident as a tragic accident rather than an intentional act. They claimed Jatrara actually assisted in transporting the victim to the hospital and suggested that the more severe charges were added under pressure from the deceased's relatives. The defense also argued that CCTV footage did not clearly show children playing at the time and emphasized Jatrara's status as a permanent resident with high social standing, asserting he posed no flight risk.
Court's Final Ruling and Rationale
After considering submissions from both sides, as well as from the intervener representing the child's family, Judge Kharadi concluded that the seriousness of the newly added charges outweighed any arguments for release. The court stated, "Considering the seriousness of the offence, if at this stage the applicant is released on bail, then it will cause hurdle in the investigation and the possibility of the applicant fleeing justice…cannot be discarded. Therefore, for the above reasons, in my view, the applicant is not entitled for bail."
The judge emphasized that the investigation must proceed without interference, particularly in light of allegations that the accused ignored the known presence of children in the area. This ruling ensures that Jatrara remains in custody as authorities continue to build their case, seeking justice for the young victim and his grieving family.
