Nashik Court Orders 14-Day Judicial Custody for Two Accused in TCS Sexual Harassment Cases

A magisterial court in Nashik on Monday remanded two accused individuals to 14 days of judicial custody in connection with multiple cases of alleged sexual harassment reported at the Tata Consultancy Services (TCS) office in Nashik. The two men are implicated in four out of the nine sexual harassment cases that have been registered so far in this ongoing investigation.

Arrest and Initial Custody Details

The accused were initially taken into custody on April 16, 2024, in relation to the third case filed against them. Following their arrest, the Special Investigation Team (SIT) was granted police custody until April 18, which was subsequently extended to April 20 to facilitate a thorough interrogation process.

Legal Charges Under Bharatiya Nyaya Sanhita

Cases have been registered against the accused under specific sections of the Bharatiya Nyaya Sanhita (BNS), which is the new penal code in India. The charges include:

  • Section 74: Assault or criminal force with intent to outrage a woman's modesty.
  • Section 75: Sexual harassment.
  • Section 79: Acts or words intended to insult the modesty of a woman.
  • Section 3(5): Common intention, indicating collaborative involvement in the alleged offenses.

Prosecution's Allegations and Accused Behavior

According to the prosecution, led by Assistant Public Prosecutor Aniket Avhad, the accused engaged in persistent and inappropriate conduct towards the complainant. The allegations detail that the accused repeatedly contacted the complainant and attempted to intrude into her private life, seeking physical proximity against her explicit wishes.

One of the accused allegedly proposed a relationship, while the other is accused of making vulgar comments about the complainant's body and touching her inappropriately, actions that are said to have outraged her modesty. Avhad emphasized to the court that the accused are habitual offenders, and a detailed probe into their alleged conduct is currently underway.

Investigation Status and Judicial Custody Request

During the court proceedings, Avhad submitted that the accused have been uncooperative during questioning, providing vague replies to investigators. He further noted that the SIT has yet to identify and record statements from potential eyewitnesses, which is crucial for building a comprehensive case.

In light of these factors, the prosecution sought 14 days of judicial custody for the accused. Additionally, Avhad requested that the prosecution's right to seek further police custody be kept open if required during the ongoing investigation, ensuring flexibility as the probe progresses.

Ongoing Probe and Future Steps

The investigation into the remaining cases is continuing, with authorities working to gather more evidence and statements. The judicial custody order allows for the accused to be held while the SIT conducts a thorough examination of all aspects related to the multiple harassment allegations.

This case highlights the serious nature of sexual harassment in workplace environments and underscores the legal mechanisms in place under the Bharatiya Nyaya Sanhita to address such offenses. The court's decision reflects a commitment to ensuring a fair and detailed investigation while maintaining judicial oversight over the custody of the accused.
