Supreme Court Orders Honourable Farewell for Ex-IAF Pilot After 33-Year Legal Battle
The Supreme Court of India has delivered a landmark judgment, restoring the honour of a former Indian Air Force pilot who faced an ignominious dismissal 33 years ago. In a powerful ruling, the court declared his termination arbitrary and illegal, directing that he be given a formal farewell with full military honours.
Decades of Injustice Finally Addressed
A bench comprising Justices Dipankar Datta and K V Viswanathan emphasized that honour remains the foremost concern for defence personnel. The court stated unequivocally that the wrongful termination must be revoked and the officer's dignity restored after more than three decades of suffering.
The bench explicitly set aside the dismissal order dated September 22, 1993, declaring it null and void. While the officer, identified as Squadron Leader R Sood, cannot be reinstated due to having crossed the age of superannuation, the court ruled he is entitled to all consequential service benefits that would have accrued to him had the illegal dismissal never occurred.
Comprehensive Compensation Ordered
The Supreme Court directed the Central government to grant the former pilot:
- 50% of salary and allowances from 1993 until his normal retirement date
- All promotional benefits he would have earned during his service
- Full pensionary benefits as if he had served his complete tenure
Most significantly, the court ordered the Chief of Air Staff to fix a date for a proper farewell ceremony, where the appellant shall be signed off in the normal manner he would have been entitled to but for the wrongful dismissal.
The Case Background
Squadron Leader R Sood's troubles began when he was ordered by a senior officer to remove a drunken driver from the campus. Following these instructions, Sood took the individual to a desolate location. Later, a dead body was discovered at that same spot, leading to criminal proceedings against the officer.
Although Sood was discharged from the criminal case due to lack of evidence, the Air Force proceeded with a court martial that resulted in his dismissal in 1993. This began a protracted legal battle that spanned more than three decades before finally reaching resolution in the Supreme Court.

The court's judgment specifically noted that justice demands the ignominy suffered by the appellant over three decades be obliterated. This ruling not only provides financial compensation but, more importantly, restores the professional honour and dignity of a service member who served his country.
