Supreme Court Condemns Attack on Judicial Officers in West Bengal, Cites Law and Order Breakdown

The Supreme Court of India on Thursday expressed strong disapproval of the violent attack on judicial officers who were carrying out its orders in West Bengal's Malda district. The apex court declared that this incident highlights a severe breakdown of law and order within the state, issuing show-cause notices to the chief secretary, director general of police (DGP), district magistrate, and superintendent of police (SP). These officials must explain why disciplinary action should not be initiated against them for their failure to maintain security.

Deliberate Attempt to Demoralize Judiciary, Says SC

In a stern rebuke, the Supreme Court characterized the assault as a "deliberate and calculated" effort to intimidate and demoralize judicial officers, thereby obstructing them from performing their constitutional duties. The court emphasized that such actions are intolerable in a democratic society and undermine the rule of law. To ensure the safety of the officers and their families, the Supreme Court directed the Election Commission of India to immediately request the deployment of central paramilitary forces across West Bengal.

Harrowing Ordeal of Seven Judicial Officers Detailed

The court's order vividly documented the traumatic experience endured by seven judicial officers, including three women, who were gheraoed (surrounded) by anti-social elements. These officers were held hostage until midnight, facing threats and harassment while attempting to adjudicate objections related to voter list exclusions in Malda district. This incident has raised serious concerns about the safety of judiciary personnel in the state and their ability to function without fear.

Central Agency Probe Ordered into the Incident

In a significant move, the Supreme Court mandated that a central investigative agency, either the Central Bureau of Investigation (CBI) or the National Investigation Agency (NIA), conduct a thorough probe into the attack. This directive aims to ensure an impartial and rigorous investigation, free from local influences, to identify and prosecute the perpetrators. The court's actions underscore its commitment to upholding judicial independence and protecting those who serve the justice system.
