Court Orders Asset Preservation in Kapoor Family Dispute
The Delhi High Court has issued an interim order directing businessman Sunjay Kapur to preserve his assets, including properties and bank accounts, following a plea filed by his children with actress Karisma Kapoor. The children sought maintenance and protection of their inheritance rights.
Background of the Case
The plea was moved by Samaira and Kiaan Raj Kapur, the children of Karisma Kapoor and Sunjay Kapur, who are currently involved in a marital dispute. The children, through their mother, approached the court seeking financial support and the preservation of assets that they claim are rightfully theirs.
Senior advocate Dayan Krishnan, representing the children, argued that Sunjay Kapur is attempting to alienate assets to defeat the claims of his children. The court, after hearing the arguments, directed Kapur to maintain the status quo regarding his assets and not to sell or transfer any property until further orders.
Details of the Court Order
Justice Jasmeet Singh of the Delhi High Court passed the order on February 28, 2025, directing Sunjay Kapur to preserve assets worth approximately Rs 2 crore. The court also issued notice to Kapur, returnable on March 28, 2025, and asked him to file a reply to the children's plea.
The children's plea, filed under Section 26 of the Hindu Marriage Act, 1955, and other provisions, seeks maintenance and educational expenses. It also requests that Kapur be restrained from disposing of his assets.
Legal Implications
This case underscores the legal rights of children in matrimonial disputes. Under Indian law, children have the right to maintenance and inheritance from their parents. The court's intervention aims to ensure that the children's interests are protected during the ongoing legal battle between their parents.
The matter is scheduled for further hearing in March 2025. Meanwhile, both parties have been advised to explore amicable settlement options.
