Telangana High Court Adjourns BrahMos DG Suspension Hearing to June 15

The Telangana High Court in Hyderabad has scheduled the next hearing for June 15 in a significant case involving petitions that challenge an order from the Central Administrative Tribunal (CAT), Hyderabad bench. This tribunal order, issued on December 29, suspended the director general of BrahMos, a key defense organization.

Interim Suspension and Court Proceedings

In January, the high court had previously ordered an interim suspension of the tribunal's directive, effectively putting a temporary hold on the suspension of the director general. The court had also instructed the involved parties to file their counter-affidavits in the matter to present their arguments formally.

When the case came up for hearing on Monday before a bench comprising Justices P Sam Koshy and Narsing Rao Nandikonda, counsels representing both sides made their initial submissions. After presenting their arguments, they requested additional time to prepare further submissions. Accepting this request, the bench decided to adjourn the matter, setting the next hearing date for June 15 to allow for more detailed presentations.

Background of the Legal Dispute

The bench is currently hearing petitions filed by the Union government and Dr Jaiteerth Joshi, an outstanding scientist at the Defence Research and Development Laboratory (DRDL). These petitions challenge the tribunal's order that suspended Dr Joshi from his position as director general of BrahMos. The suspension was a result of a petition filed by Dr Sivasubramaniam Nambi Naidu, a distinguished scientist at the Defence Research and Development Organisation (DRDO).

During a previous hearing, the court had recorded that Dr Naidu had filed a counter-affidavit in response to the petitions. Dr Naidu had originally challenged Dr Joshi's appointment as director general before the tribunal, alleging that he was unfairly superseded despite being the senior-most candidate. He claimed to have seven years more seniority than Dr Joshi and has held the position of outstanding scientist since 2017.

Tribunal's Initial Ruling and Implications

In disposing of Dr Naidu's petition, the Central Administrative Tribunal issued orders to suspend Dr Joshi from his role as director general of BrahMos. Additionally, the tribunal directed the Union defence ministry to appoint an in-charge official to oversee the position until a final decision is reached in the case. This move has sparked a legal battle that now involves multiple high-level stakeholders, including government bodies and scientific experts.

The case highlights ongoing tensions within India's defense research sector, particularly regarding appointments and seniority disputes. As the matter progresses, it is expected to draw significant attention from legal and defense communities, with potential implications for administrative procedures in government organizations.

The adjournment to June 15 allows both parties to refine their legal strategies, ensuring a thorough examination of the facts and arguments involved. The outcome of this hearing could set precedents for similar cases in the future, affecting how senior appointments are contested and resolved within India's public sector.
