Telangana High Court Directs GHMC to Address Jubilee Hills Cafe Construction Complaint
The Telangana High Court issued a significant directive on Wednesday, ordering the Greater Hyderabad Municipal Corporation (GHMC) to formally consider a representation concerning alleged unauthorized construction activities undertaken by Caffe Jubilee at the premises of the Jubilee Hills Co-operative House Building Society. The court has mandated that the civic body must take appropriate action on this representation within a strict timeframe of three weeks, ensuring all procedures are followed in accordance with the established law.
Petition Alleges Building Violations and Commercial Misuse
Justice NV Shravan Kumar delivered these directions while presiding over a petition filed by two members of the housing society. The petitioners raised serious allegations of significant building violations and unauthorized commercial activities being conducted by the society. They specifically sought judicial intervention to compel the GHMC and other relevant authorities to investigate and act upon these reported violations promptly.
The core of the complaint centers on the alleged misuse of the society's community hall for commercial purposes that are open to the general public. This activity, according to the petitioners, constitutes a clear violation of the originally sanctioned building plan. The petitioners provided detailed background, stating that the GHMC had granted permission in November 2013 for a specific structure. This approved plan included a sub-cellar, a parking cellar, and two upper floors, all of which were intended to be used exclusively as a community hall for the benefit and use of the society's members only.
Court's Directive for Timely Legal Action
The High Court's order emphasizes the necessity for the municipal corporation to adhere to legal protocols while addressing the grievances presented. By setting a three-week deadline, the court has underscored the urgency of the matter and the importance of regulatory compliance in urban construction and land use. This directive places the onus on the GHMC to conduct a thorough review of the representation, examine the alleged deviations from the sanctioned plan, and determine whether the operations of Caffe Jubilee align with the permitted usage of the premises.
This case highlights ongoing concerns regarding building regulation enforcement and the prevention of unauthorized commercial activities within residential cooperative societies in Hyderabad. The court's intervention seeks to ensure that municipal authorities fulfill their statutory duties to uphold building laws and address citizen complaints effectively, thereby maintaining the integrity of urban planning and development in the region.
