Thane Court Acquits Man in Minor Rape Case Citing Evidence Gaps
A Thane court has acquitted a 53-year-old man of charges of raping a minor girl, delivering a verdict that underscores significant evidentiary shortcomings in the prosecution's case. The court ruled that the evidence presented was not "cogent and clinching" and raised serious questions about the minor girl's claim of recording the alleged act on her mobile phone.
Court Questions Credibility of Evidence
Special Judge Premal S Vithalani, in the order dated April 9, highlighted multiple contradictions in the girl's testimony, which played a pivotal role in the acquittal. The prosecution had alleged that between December 2022 and January 2023, the man, a tailor by profession and neighbor of the 17-year-old girl in Thane city, sexually assaulted her on multiple occasions. According to the case, he obtained her house keys from her mother, who worked as a cook in the locality and would lock the house from outside, leaving the keys with the tailor until her return.
The victim claimed she had secretly filmed one such incident on January 14, 2023, using her mobile phone. However, the court expressed skepticism, stating, "It is highly improbable that the culprit committing rape would allow the minor girl to video shoot the act on the mobile phone." This observation cast doubt on the veracity of the recording claim, which was a central piece of evidence.
Contradictions in Testimony Highlighted
Judge Vithalani also pointed out significant inconsistencies between the victim's court testimony and her earlier statement to a magistrate. In her court testimony, the girl stated that the first incident occurred at the man's house during a tailoring visit. In contrast, her prior statement to the magistrate claimed he entered her house to commit the crime. These contradictions further weakened the prosecution's case, as they raised questions about the reliability and consistency of the victim's account.
The court's decision emphasizes the legal principle that evidence must be clear, consistent, and convincing to secure a conviction. In this instance, the lack of corroborative evidence and the discrepancies in the victim's statements led to the acquittal.
