The Motor Accident Claims Tribunal (MACT) in Thane has delivered a significant verdict, awarding compensation of nearly Rs 46.6 lakh to the grieving family of a man who tragically lost his life in a devastating road accident that occurred in Palghar district nearly nine years ago. The tribunal unequivocally held the driver of a truck responsible for the fatal collision and directed the concerned insurance company to disburse the substantial compensation amount to the victim's dependents.

Details of the Tragic Accident and Legal Proceedings

According to the detailed tribunal order, the catastrophic accident took place on May 13, 2017, at approximately 8:00 AM. The incident occurred on the Gorhaphata–Kanchadphata road near Sai Devaligaon in Wada taluka of Palghar district. The victim was traveling as a passenger in an SUV when a truck, approaching from the opposite direction at high speed and operating in a rash and negligent manner, violently collided with the vehicle head-on.

The impact of the collision was severe, causing critical injuries to the victim, including grave head trauma, to which he later succumbed. Several other occupants of the SUV also sustained injuries in the accident. Following the incident, local police promptly registered an offence and filed a comprehensive chargesheet against the truck driver, initiating the legal process.

Tribunal's Investigation and Findings

During the extensive hearing process, the MACT meticulously examined a range of crucial documents, including:

  • The spot panchanama (scene investigation report)
  • The post-mortem examination report
  • Various other investigation records and evidence

After thorough scrutiny, the tribunal conclusively determined that the accident occurred solely due to the rash and negligent driving of the truck driver. Evidence presented before the tribunal further revealed that the deceased was gainfully employed as an operator in a private company, and his family was entirely dependent on his income for their livelihood.

Calculation of Compensation and Insurance Implications

The tribunal undertook a detailed assessment of the victim's earnings, his age at the time of death, and the number of dependents relying on his financial support. Based on these factors, the compensation amount of Rs 46,60,000 was calculated and deemed payable to the claimants.

In a critical observation, the tribunal noted that the truck driver did not possess a valid licence to operate transport vehicles at the time of the accident. This constituted a clear breach of the insurance policy conditions. However, adhering to established legal principles governing third-party motor accident claims, the tribunal directed the insurance company to first deposit the full compensation amount with the tribunal.

The order mandates that the compensation carry an annual interest rate of 9%, calculated from the date the claim petition was originally filed. The insurance company has been granted the liberty to subsequently initiate appropriate legal proceedings to recover the disbursed amount from the owner of the truck involved in the accident.

Distribution of the Awarded Compensation

The substantial compensation amount will be systematically distributed among the deceased's legal heirs and dependents in strict accordance with the tribunal's final order, providing them with much-needed financial support and a measure of justice after their prolonged ordeal.
