Thane MACT Awards Rs 5 Lakh Compensation in 23-Year-Old Motorcycle Accident Case
The Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane district has delivered a significant ruling, awarding compensation of Rs 5 lakh to the family of a young tutor who tragically lost her life in a motorcycle accident 23 years ago. This long-awaited decision brings a measure of closure to a case that has lingered for over two decades.
Details of the Fatal Accident
The victim, identified as Serena Pereira, was a 24-year-old tutor earning Rs 3,300 per month at the time of the incident. On September 18, 2003, Pereira was riding pillion on a motorcycle along the busy Mumbai-Ahmedabad highway at Kashimira. According to the case details, a speeding truck collided with the two-wheeler, causing Pereira to fall from the motorcycle and come under the wheels of the heavy vehicle. The impact was so severe that she died instantly at the scene.
Legal Proceedings and Tribunal Findings
The legal journey for justice began when the mother and sister of the deceased filed a petition in 2020, seeking compensation for their loss. In their submission, they alleged that a Thane Municipal Transport (TMT) bus was also involved in the accident, claiming that the motorcycle became trapped between the truck and the bus during the collision.
After thorough examination of the evidence, Judge K P Shrikhande delivered the order, holding the owners of both the truck and the motorcycle involved in the accident liable for the tragedy. The tribunal directed them to pay the compensation amount with an annual interest rate of 9%, effective from March 2024.
However, the tribunal dismissed the claim against the transport authority, stating that the allegation regarding the TMT bus's involvement was contrary to the official police reports filed at the time of the accident.
