Ujjain: Minor raped by brothers after alcohol given by elder sibling

A shocking case of sexual assault has emerged from a village in Ujjain district, where a 13-year-old girl was allegedly raped by her two minor brothers. The incident, which came to light on the night of December 3, reportedly occurred after the survivor's adult elder brother made her consume alcohol.

Sequence of Events Leading to the Assault

According to police officials, the accused adult brother called the minor girl and forced her to drink alcohol. Two of his minor brothers were also present at the scene. Due to the effects of the alcohol, the girl fell and sustained injuries. It was during this vulnerable state that the two minor brothers allegedly sexually assaulted her.

Khachrod police station in-charge, Dhansingh Nalwaya, provided crucial details, stating that a minor friend of the survivor witnessed the entire incident. The survivor later managed to inform her family members about the trauma she endured.

Police Action and Legal Proceedings

The next morning, on December 4, the family took the girl to Khachrod hospital for medical attention. Upon receiving information, police personnel arrived at the hospital and recorded the survivor's official statement.

Law enforcement has registered a case under relevant sections of the Bharatiya Nyaya Sanhita (BNS), the Protection of Children from Sexual Offences (POCSO) Act, and the Juvenile Justice Act. The investigation has been taken up promptly.

The adult brother, who provided the alcohol, was produced before a court and has been sent to judicial custody. Meanwhile, the two minor accused brothers have been sent to a juvenile home as per legal protocol. The minor survivor's medical examination was also conducted as part of the standard procedure in such cases.

Broader Implications and Community Impact

This distressing incident has sent shockwaves through the local community in Ujjain. It highlights severe lapses in child protection within a family setting and raises alarming questions about safety and guardianship. The use of alcohol to incapacitate a minor before the assault adds a grave dimension to the crime.

The swift registration of the case under stringent laws like the POCSO Act reflects the legal framework's intent to deal severely with crimes against children. The case will now proceed through the judicial system, with the focus on ensuring justice for the young survivor while handling the minor accused according to the provisions of the Juvenile Justice Act.
