Uttar Pradesh Fast-Track Court Delivers Death Sentence in Child Assault and Murder Case
A fast-track court in Kushinagar district, Uttar Pradesh, has issued a death sentence by hanging to a 22-year-old man for the sexual assault and murder of a seven-year-old boy. The judgment was delivered on Wednesday by Special Judge Dinesh Kumar, who presided over the case under the Protection of Children from Sexual Offences (Pocso) Act.
Swift Justice in a Heart-Wrenching Crime
The court's decision came within a remarkably short span of 30 working days from the registration of the First Information Report (FIR) on February 23 and the filing of the chargesheet on March 7. This expedited process underscores the judicial system's commitment to addressing heinous crimes against children with urgency and severity.
The accused, identified as Pintu alias Koyal, was convicted under multiple legal provisions. The charges included Section 103(1) of the Bharatiya Nyaya Sanhita (BNS) for murder and Section 238A for causing the disappearance of evidence, in addition to relevant sections of the Pocso Act. In addition to the death penalty, the court imposed a fine of Rs 4 lakh on the convict. This monetary penalty is designated to be paid to the victim's mother as compensation for rehabilitation purposes.
Investigation and Evidence That Sealed the Conviction
Keshav Kumar, the Superintendent of Police (SP) of Kushinagar, who closely monitored the investigation, provided detailed insights into the case. The tragic incident unfolded on the evening of February 22 when the young victim attended a tilak ceremony in his village but failed to return home. A missing person report was filed the following morning, and within hours, locals discovered the boy's body near his residence.
A postmortem examination confirmed that the cause of death was asphyxiation and also established that the child had been sexually assaulted, adding a layer of brutality to the crime.
The investigation took a significant turn when it was revealed that Pintu, a relative of the victim, had been missing since the night of the incident. A search of his house led to the recovery of blood-stained shorts, which a family member confirmed the suspect had worn on the night of the crime. This discovery provided a crucial lead for the police.
Forensic Science and Confession Play Pivotal Roles
Further strengthening the case, police interviewed the suspect's wife, who had been living at her parental home for several months. Her statements added to the suspicion against Pintu. Investigators pieced together that the suspect had lured the child to a secluded location with the promise of money, sexually assaulted him, and then killed him to avoid identification. After the murder, he hid the body before fleeing the scene.
Forensic evidence proved to be instrumental in securing a fast conviction. The blood-stained shorts and a used condom recovered near the body were sent for forensic analysis. A DNA report, obtained within seven days through a request to the Forensic Science Laboratory (FSL), matched the suspect's DNA with samples found on the victim. This scientific evidence was promptly incorporated into the chargesheet, creating a watertight case for the prosecution.
During interrogation, the accused confessed to the crime, and he was subsequently sent to jail on February 25. The trial records have now been forwarded to the high court for confirmation of the death sentence. Until the confirmation process is complete, the convict will remain lodged in Deoria district jail.
This case highlights the effectiveness of fast-track courts in delivering justice in sensitive matters, particularly those involving crimes against children. The swift collection of evidence, combined with forensic advancements and thorough investigation, ensured that the perpetrator was held accountable in a timely manner, providing a measure of closure to the grieving family.
