Uttarakhand High Court Takes Action on Medical Waste Crisis in Pithoragarh

In a significant move, the Uttarakhand High Court has intervened to address the alarming issue of medical waste disposal in Pithoragarh district. The court has directed the state government to provide a detailed report on the situation within four weeks, following a Public Interest Litigation (PIL) that highlighted severe violations of biomedical waste management rules.

PIL Exposes Hazardous Waste Practices

The PIL, filed by Dr. Rajesh Pandey, a resident of Pithoragarh, brought to light the district's lack of proper facilities for disposing of biomedical waste. As a result, waste from government and private hospitals, as well as pathology laboratories, is being indiscriminately dumped into rivers, drains, pits, and municipal garbage bins. This practice poses a serious threat to human health, animals, and the environment, increasing the risk of disease outbreaks.

Counsel for the petitioner emphasized that this illegal dumping violates established biomedical waste management regulations, creating a public health emergency. The petition also noted that animals are consuming this hazardous waste, adversely affecting their health, and flagged that approximately 20 pathology laboratories in the district are operating without basic registration with the State Pollution Control Board.

Court's Directive and Government Response

A division bench comprising Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay heard the case and ordered the state to file a report on the prevailing conditions. The chief medical officer of Pithoragarh acknowledged the district's inadequate disposal mechanisms, which have led to difficulties in waste management and haphazard disposal by healthcare facilities.

The petitioner has urged the court to direct the state to establish a common biomedical waste treatment facility in Pithoragarh, especially given its status as a border district, to prevent further environmental degradation and health hazards.

This case underscores the urgent need for improved waste management infrastructure in Uttarakhand to safeguard public health and comply with environmental laws.
