Uttarakhand High Court Issues Directives for Nainital Civic Issues

The Uttarakhand High Court has issued fresh directions in a public interest litigation (PIL) addressing two critical civic concerns in Nainital district. The PIL was filed by Anil Yadav, a resident, highlighting urgent roadside safety repairs and the identification of a municipal waste dumping site.

Court Orders Priority Road Safety Repairs

Hearing the matter, a bench comprising Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay recorded the state's assurance that damaged crash barriers were being repaired on a priority basis. The court directed that this work be completed in accordance with the state's submission.

In its April 8 order, the court noted a status report filed via affidavit by the executive engineer of the provincial division, Public Works Department (PWD), Nainital, confirming that repairs were already underway. The state counsel also submitted written instructions dated April 7 reiterating this commitment.

The court specifically mandated that on the Nainital-Haldwani route, between Bhowali and Kainchidham, repairs to crash barriers and parapets must be completed within 15 days. This directive aims to enhance road safety and prevent accidents in this crucial stretch.

Municipal Waste Dumping Site Challenges

The second issue before the court pertained to the Nagar Palika Parishad, Nainital, and the proposed construction of an approach road to a municipal waste collection and dumping site. Counsel for the state informed the bench that the deputy conservator of forest, Nainital forest division, had conveyed that permission for felling trees could only be granted by the central government.

This is because the construction of the approach road qualifies as a non-forest activity, a matter falling within the central government's jurisdiction under environmental regulations.

Taking note of this position, the high court permitted the Nagar Palika Parishad to approach the central government for the necessary clearance. Simultaneously, the court directed the district magistrate to examine whether any alternative land was available near the main road that could be used for a waste collection and dumping facility without requiring central approval. This dual approach is intended to expedite the process and address the pressing waste management issue in the area.

Next Steps and Compliance

The matter has been listed for hearing after four weeks. The court has directed the concerned respondents to file status reports on both issues—the road safety repairs and the waste dumping site resolution—by that time. This ensures ongoing monitoring and accountability in implementing the court's directives.

These judicial interventions underscore the high court's proactive role in addressing public infrastructure and environmental concerns in Uttarakhand, particularly in tourist-heavy regions like Nainital where civic amenities are crucial for both residents and visitors.
