Vadodara Consumer Forum Dismisses Insurance Claim Due to Unregistered Car Sale

A consumer forum in Vadodara has firmly rejected an accident insurance claim filed by a man who sold his vehicle but neglected to officially transfer its ownership with the regional transport office (RTO). This decision underscores the critical importance of adhering to legal procedures in vehicle transactions to maintain insurance validity.

Case Details and Ruling

The Vadodara District Consumer Disputes Redressal Commission dismissed the complaint from Amit Sharma, ruling that he lacked an "insurable interest" in the car after its sale. According to case records, Sharma sold his car to his friend Ankur Damle in August 2023 and executed a sale deed. In November 2023, Damle was involved in an accident while driving the vehicle, resulting in significant damage.

Sharma subsequently filed an insurance claim for Rs 2.94 lakh with Tata AIG General Insurance Company Ltd, but the insurer rejected it. In May 2024, he approached the consumer forum, seeking the claim amount along with interest and compensation of Rs 25,000 each for mental harassment and legal expenses.

Insurance Company's Arguments

The insurance company contended that Sharma violated policy conditions by failing to inform the RTO about the sale within 14 days, as mandated under the Motor Vehicles Act. Additionally, the insurer highlighted that the insurance policy was not transferred to the buyer's name within the required period.

After reviewing both sides, the commission noted that since the vehicle had been sold and neither the ownership nor the insurance policy were transferred as per regulations, Sharma could not be considered to have an insurable interest in the vehicle. Consequently, the forum rejected the complaint, stating that Sharma was not entitled to claim insurance for the accident.

Implications for Vehicle Owners

This case serves as a stark reminder for vehicle owners to ensure all legal formalities are completed promptly after a sale. Key steps include:

  • Informing the RTO within 14 days of the sale.
  • Transferring the insurance policy to the new owner's name.
  • Maintaining proper documentation to avoid future disputes.

Failure to comply with these requirements can lead to the loss of insurance coverage, as demonstrated in this instance. Consumers are advised to stay vigilant about regulatory obligations to protect their financial interests.
