Kerala Government Advocates for Expedited Approval of Kollam ESI Medical College

The Kerala state government has formally informed the High Court that the establishment of a medical college at Asramam in Kollam is a critical necessity. The government has urged that the request from the Employees' State Insurance (ESI) Corporation for this project should be approved expeditiously, ideally within a four-week timeframe, provided all essential conditions are fully met.

Petition Filed by Kollam MP N K Premachandran

This submission was made in direct response to a petition filed by Kollam Member of Parliament N K Premachandran. The petition sought a judicial directive compelling the state government to issue an essentiality certificate to the ESI Corporation. This certificate is a mandatory prerequisite that would enable the Corporation to formally submit its application for establishing the ESI Medical College at Asramam in Kollam.

Premachandran argued in his petition that despite the ESI Corporation applying for the essentiality certificate, the state government had previously communicated that the proposed institution lacked the necessary faculty and clinical infrastructure to commence an MBBS program in accordance with the stringent norms set by the National Medical Commission (NMC). He further alleged that even after the Corporation submitted a comprehensive, detailed action plan outlining proposed rectification measures to address these deficiencies, no subsequent action or progress had been taken by the state authorities.

Government's Stance on Compliance and Certification

In its official response to the court, the state government clarified its position. It stated unequivocally that it could not issue the essentiality certificate unless it was fully satisfied that all requirements for the proposed medical college strictly complied with NMC regulations. This comprehensive compliance check includes the land, academic buildings, clinical infrastructure, faculty and resident staff, medical equipment, and all other mandatory prerequisites.

The government acknowledged through its special government pleader that the need to commence an MBBS course at the existing ESI Model and Super Specialty Hospital in Kollam is significant and cannot be ignored. However, it emphasized that this commencement must absolutely adhere to the established guidelines and regulations of the National Medical Commission. The pleader assured the court that once the government is satisfied that the ESI Corporation has demonstrably complied with all applicable norms, it will prioritize and expedite the issuance of the requisite certificate to officially commence the MBBS course.

High Court Disposes of the Petition

After carefully noting the detailed submissions from both parties, the bench comprising Chief Justice Soumen Sen and Justice V M Syam Kumar disposed of the petition. The court's disposition effectively closes this specific legal proceeding, having recorded the government's commitment to a swift, conditional approval process for the vital medical college project in Kollam.
