Kerala High Court Seeks Election Commission's Response on EVM Security Petition
The Kerala High Court has taken a significant step by seeking detailed instructions from the Chief Election Commissioner and other relevant authorities concerning a crucial petition. This petition specifically demands the implementation of robust transparency and continuous monitoring mechanisms for the custody of electronic voting machines (EVMs) during the critical post-polling and pre-counting phase of the upcoming state assembly elections in 2026.
Judicial Intervention on Election Integrity
A bench presided over by Justice Bechu Kurian Thomas issued this important directive in response to a formal petition submitted by Thomas Joseph, a resident of Kozhikode. The petitioner has raised serious allegations regarding the existing legal framework, which he claims lacks enforceable guidelines for proper stakeholder oversight during this highly sensitive electoral period. The court has subsequently adjourned the matter for a more detailed consideration, scheduling the next hearing for March 31.
Concerns Over the "Black Box" Period
In his detailed petition, Joseph highlighted what is often termed the "black box" period—the interval between the completion of polling and the official commencement of vote counting. He argued that this phase is exceptionally vulnerable, as EVMs are stored in designated strong rooms without a transparent, independent, and continuously accessible monitoring system for all authorized stakeholders.
The petitioner pointed to documented instances from recent elections, including CCTV system outages, incidents of unauthorized access, and various security breaches at these strong rooms. Despite these reported lapses, the current protocols allegedly do not provide sufficient safeguards or clear, actionable guidelines to prevent such occurrences.
Demand for Enhanced Safeguards
Joseph further stated that a comprehensive representation detailing these security concerns had already been formally submitted to the Election Commission of India. However, according to the petition, no concrete action or response has been initiated by the Commission to address these pressing issues thus far.
The core request in the petition is a judicial directive compelling the Election Commission to enforce stringent transparency measures. These proposed measures include:
- Ensuring uninterrupted CCTV surveillance of EVM strong rooms, with real-time or recorded access granted to authorized stakeholders, including candidates and their representatives.
- Implementing regulated and secure protocols allowing for the presence of authorized candidate representatives in the vicinity of the EVM storage facilities to provide an additional layer of oversight.
The petitioner contends that such measures are not merely procedural but are essential to uphold the basic structure of the Constitution and to fundamentally ensure the sanctity and credibility of free and fair elections in the democratic process.
