Stalin Celebrates Supreme Court's OBC Creamy Layer Ruling as Landmark Victory

Chennai: Chief Minister M K Stalin on Thursday enthusiastically welcomed the Supreme Court judgement on the OBC creamy layer, describing it as "a decisive victory for OBC justice after years of struggle." The landmark ruling has significant implications for reservation policies and social justice across India.

Clarifying Income Criteria for Creamy Layer Determination

"I welcome the Supreme Court's judgement clarifying OBC non-creamy layer determination," Stalin stated emphatically. The court's clarification establishes that salary income cannot be equated with income from business or property when determining creamy layer status, a distinction that protects genuine OBC aspirants from wrongful exclusion from reservation benefits.

The judgement specifically:

  • Shields authentic OBC candidates from improper exclusion from reservation benefits
  • Upholds previous high court rulings regarding civil services eligibility criteria
  • Rejects hostile discrimination practices across various employment sectors
  • Reaffirms that reservation's fundamental purpose is remedying historical social backwardness

Political Criticism and Constitutional Concerns

Stalin launched a pointed attack against the BJP-led central government, accusing it of actively fighting against what he called 'genuine' OBC candidates. "The NDA government defended a position that could have excluded many authentic OBC candidates and introduced the EWS quota, departing from the constitutional basis of reservations," he asserted.

The Chief Minister highlighted concerning statistics, noting that "even today, after three decades of Mandal Commission recommendations, many OBC posts remain unfilled in premier institutions and the Union government." This persistent underrepresentation, according to Stalin, demonstrates systemic failures in implementing reservation policies effectively.

DMK's Legacy and Future Demands

Asserting the DMK's consistent advocacy for social justice, Stalin referenced the party's achievement in securing 27% OBC reservation in the all India quota of medical seats. Building on this legacy, he issued a direct appeal to the BJP government at the center.

Stalin urged the central administration "to create supernumerary seats for OBC candidates who cleared the civil services examination but were denied their rightful place, and rectify this injustice in the spirit of constitutional equality." This demand seeks to address historical wrongs and ensure that qualified OBC candidates receive opportunities commensurate with their achievements.

The Supreme Court's clarification comes at a critical juncture in India's ongoing conversation about social justice, representation, and equitable opportunity. By distinguishing between different types of income for creamy layer determination, the judgement potentially expands access to reservation benefits for numerous OBC families across the country while maintaining the constitutional framework designed to address historical disadvantages.
