Karnataka HC orders confirmation of 26 police officers as SPs

The Karnataka High Court has recently directed the state government to confirm the promotions of 26 police officers to the rank of Superintendent of Police (SP) within two months. This decision comes after the government challenged an earlier order from the Karnataka Administrative Tribunal (KAT).

Background of the Promotions

In November 2023, the state government promoted 35 Deputy Superintendents of Police (DSPs) to the rank of SP (non-IPS) through a departmental promotion committee. However, these promotions were granted on a temporary basis. Out of the 35 officers, nine retired without their promotions being confirmed.

Long Service History

These officers joined the police force as sub-inspectors and were later promoted to DSPs after 30 years of service. They were confirmed as DSPs in 2015. After being promoted to SP, they made multiple representations to the government seeking confirmation of their promotions. When that failed, they approached the Karnataka Administrative Tribunal last year.

High Court Order

The tribunal ordered the government to consider confirming the promotions. Instead of complying, the government appealed against the order in the High Court. After hearing both sides, the High Court dismissed the appeal and directed the government to confirm the promotions within two months from the date of the order, which was April 24.

A senior police officer stated, "The High Court has made it clear that the promotions must be confirmed, and the government has no valid reason to delay further."

This ruling is expected to benefit the 26 officers who have been waiting for official confirmation of their ranks, ensuring their service status is regularized.
