Labour Commissioner Mandates Paid Holiday for Workers to Vote in Assembly Elections
In a significant move to bolster voter participation, the Labour Commissioner has issued a directive requiring all industrial and commercial establishments, shops, IT companies, public sector undertakings, and unorganized sector units to grant a paid holiday to their employees on specific dates for the upcoming assembly elections. According to the order, employees in Puducherry must be given a paid holiday on April 9, while those in Tamil Nadu should receive one on April 23. This measure aims to ensure that workers can exercise their democratic right to vote without any financial hardship.
Comprehensive Coverage Across Sectors
The order, released on Saturday, extends its applicability to a wide range of sectors, including food establishments, plantations, motor transport undertakings, beedi and cigar establishments, factories, and the construction industry. It explicitly covers all categories of workers, such as daily wage earners, temporary staff, and contract laborers. The commissioner emphasized that this inclusive approach is crucial to guarantee that every eligible voter, regardless of employment status, has the opportunity to cast their ballot in their respective constituencies.
Legal Basis and Enforcement Measures
This decision aligns with the Election Commission's instructions under Section 135(B) of the Representation of the People Act, 1951, which mandates facilities for employees to vote. The commissioner has issued a stern warning, stating that establishments and employers who fail to comply with this rule will face strict action. To facilitate the implementation of this directive, control rooms have been established by the labour department at both the state and district levels. These control rooms are designed to receive and address complaints from workers regarding any violations of the paid holiday order.
