Punjab Village Gram Sabha Proposes Ban on Marriages Between Residents
The gram sabha of Oyind village, located in the Ropar district of Punjab, has sparked controversy by proposing a ban on marriages between its residents. This resolution, passed on Tuesday, warns of a social boycott for anyone who defies the decision or supports such unions, aiming to preserve the village's social fabric.
Rationale Behind the Ban
According to village nambardar Kuldeep Singh, the move was prompted by recent incidents where couples from the same village married, leading to family conflicts and violence. He explained that the most recent case, recorded last month, nearly resulted in a fatality, prompting the gram sabha to take collective action. A nambardar serves as a traditional village functionary, acting as a liaison between the gram sabha and the government.
Kuldeep Singh stated, "The dispute could have ended in a fatality. That is why the gram sabha took this collective decision to prevent further weakening of the brotherly bond among residents."
Local Support and Legal Challenges
While some locals and panchayat members have defended the resolution, legal experts have raised significant concerns about its validity. The resolution requires approval from the district administration to be enforced, but Ropar Deputy Commissioner Aditya Dachalwal has already declared it lacks legal sanctity.
Aditya Dachalwal commented, "I will look into the matter as it has social implications, including social boycott, but under current law, such a ban is not legally binding."
Advocate J P S Dher emphasized that the resolution contradicts fundamental rights under Article 21 of the Constitution, which guarantees adults the right to choose a life partner. He predicted that if challenged in court, the resolution would likely be declared null and void.
