Deepak Prakash, the son of former Union Minister Upendra Kushwaha, is facing the prospect of losing his ministerial berth in the Bihar government. Deepak, who is neither a member of the State Assembly nor a member of the Legislative Council, was sworn in as a minister in the Samrat Government on May 7. His appointment has raised constitutional questions, as the Indian Constitution requires a minister to become a member of the state legislature within six months of taking office. Since Deepak does not hold any legislative position, he must either win a by-election or be nominated to the Legislative Council to retain his post. However, with no by-elections currently scheduled and the ruling coalition showing reluctance to nominate him, his position remains precarious. Political analysts suggest that this situation could lead to a reshuffle in the cabinet, potentially affecting the Rashtriya Lok Morcha, the party led by Upendra Kushwaha. The development has sparked debates over the criteria for ministerial appointments and the role of political families in state governance.
