Misalignment with Modern Economy
The rapid growth of e-commerce and platform-based businesses has led to a surge in gig workers, including delivery personnel, ride-hailing drivers, and freelance professionals. However, the existing labour laws do not adequately cover these workers, leaving them vulnerable to exploitation and uncertain working conditions. The policy expert argued that the legal framework must evolve to recognize the distinct nature of gig work and provide appropriate protections.
Need for Redesign
The expert called for a holistic redesign of labour laws, focusing on three key areas: social security, minimum wage guarantees, and dispute resolution. For instance, gig workers should be entitled to benefits such as health insurance, provident fund contributions, and accident coverage. The expert also stressed the importance of creating a regulatory body to oversee the gig economy and ensure compliance with new norms. This body could also facilitate data collection on gig workers, enabling evidence-based policy-making.
Challenges Ahead
While the need for reform is urgent, implementing changes will be challenging due to the diverse nature of gig work and the resistance from platforms that benefit from the current flexibility. The policy expert suggested a phased approach, starting with sectors where gig workers are most numerous, such as food delivery and transportation.
