The determination is limited to a narrow subset of historical import entries, according to a company statement.

Following an on-site verification of Waaree's manufacturing facility in India, CBP expressly confirmed that Waaree did not export solar modules using Chinese-origin solar cells to the US. The company fully cooperated throughout the investigation, and CBP drew no adverse inference against Waaree. Additionally, CBP declined the petitioner's request to make an evasion finding covering all of Waaree's imports.

Legal Recourse and Business Continuity

Waaree noted that the determination is not a final adjudication. The company is evaluating all available legal remedies with its US trade counsel. Under applicable US law, Waaree has the right to seek a de novo administrative review and thereafter judicial review before the US Court of International Trade. Waaree's US business continues to operate normally with no impact on manufacturing, customer deliveries, or commercial operations.

Background of the Investigation

The clarification came amid media reports about a June 23 determination by CBP under the Enforce and Protect Act (EAPA) investigation, which had alleged that Waaree evaded certain anti-dumping and countervailing duty orders applicable to specific solar imports linked to Vietnam and Malaysia. Waaree Energies, India's largest solar PV module manufacturer, has expanded its manufacturing footprint to the US with a solar module facility.
