Odisha Government Implements Comprehensive Ban on Tobacco-Containing Food Products

In a significant public health move, the Odisha government has issued a sweeping prohibition on all food products containing tobacco and nicotine, expanding and strengthening the existing gutka ban that has been in effect since 2013. The new regulation, announced by the state health and family welfare department, represents a major escalation in tobacco control efforts across the eastern state.

Expanded Scope of Prohibition

The latest order imposes a complete ban on the manufacture, storage, distribution, sale, and consumption of gutka and all food products containing tobacco or nicotine. This comprehensive prohibition extends to various popular tobacco products including:

  • Gutka
  • Pan masala
  • Zarda
  • Khaini
  • Other similar tobacco-containing preparations

Notably, the ban specifically targets all food products in the form of gutka, pan masala, flavoured or scented food products, or chewable food products regardless of their packaging status or marketing names. The regulation also covers products sold as separate items but packaged in a manner that facilitates easy mixing by consumers.

Addressing Regulatory Loopholes

According to Odisha's Director of Public Health, Nilakantha Mishra, the new order was necessitated by traders finding ways to circumvent the 2013 gutka ban. The modified regulations seek to remove ambiguities, ensure legal clarity, and enable uniform implementation across the state, creating a more robust framework for enforcement.

The order explicitly reiterates that tobacco and nicotine cannot be used as ingredients in any food product under existing food safety regulations. This clarification aims to prevent manufacturers from exploiting regulatory gray areas that existed under previous guidelines.
