Indian Army Raises Security Concerns Over Proposed Mall Near Military Academy

DEHRADUN: The Indian Army has formally raised objections to a private builder's plan to construct a shopping mall on land adjacent to the prestigious Indian Military Academy (IMA) in Dehradun. In letters dated February 3 and 4, the Army questioned how the project was granted permission without obtaining a mandatory No-Objection Certificate (NOC) from the IMA authorities.

Violation of Defense Guidelines

The Army's correspondence, addressed to the District Magistrate, the Mussoorie Dehradun Development Authority (MDDA), and other concerned authorities, cited established norms governing construction near defense establishments. The letters specifically referenced Ministry of Defense (MoD) guidelines that prohibit any single-storey construction within 100 meters of defense land and restrict four-storey buildings within 500 meters.

"The proposal is in clear contravention of existing policy guidelines, particularly those related to construction in proximity to defense land and the mandatory requirement of obtaining prior clearance/NOC from the local military authority," stated the Army's communication.

MDDA Rejects Building Application

Following the Army's intervention, the MDDA rejected the construction application submitted by Shivam Builders and Developers on Wednesday. Bansidhar Tiwari, Vice-Chairperson of MDDA, confirmed that the rejection came after careful consideration of the Army's objections.

"The application was rejected after MDDA took cognizance of the objections raised by the Army. The applicant had been given two months to obtain the NOC from IMA but failed to do so. Consequently, the building map has also been rejected," Tiwari explained.

Builder's Perspective and Army's Response

Rajendra Aggarwal, Managing Director of Shivam Builders and Developers, defended their position, claiming they had "followed all norms" for their proposed 'Doon Curve' project near IMA in the Panditwadi area. The Rs 35 crore project was planned on 4,445 square yards of land.

"We visited IMA officials and the Uttarakhand sub-area for the NOC but received no response. With the MDDA's approval of our map and no objection from Army authorities, we assumed there were no issues," Aggarwal stated, adding that all due processes were properly documented.

However, an Army officer familiar with the development clarified the military's position: "The Indian Army does not respond to queries from private parties but flags concerns to the relevant authorities. No response does not imply consent for such construction."

Security Implications for Military Academy

The Army emphasized that the proposed building would have posed serious security risks for IMA cadets, including foreign trainees at the prestigious institution. The officer explained that proximity of commercial establishments to sensitive defense installations creates potential vulnerabilities that cannot be overlooked.

The Army's letters to authorities included several critical questions regarding the approval process:

  • Whether the mandatory distance criteria of 100m and 500m from defense land were properly examined
  • Whether prior NOC/clearance from the local military authority was obtained before building plan approval
  • Whether MoD guidelines were duly considered during the approval process

The Army also questioned the legal authority under which the building plan was originally approved, terming the proposed construction as potentially illegal given the security implications for one of India's premier military training institutions.
