A division bench comprising Chief Justice G Narendar and Justice Subhash Upadhyay heard a suo motu public interest litigation on Friday that seeks fresh elections for five zila panchayat members in Nainital. The court intervention comes amid serious allegations of kidnapping and ballot paper tampering during the August 14 elections for the chairperson and vice-chairperson positions.

The bench issued specific directives, ordering the five members who were allegedly abducted to appear in person before the court. Additionally, the court has demanded that the Nainital SSP submit a detailed progress report on the ongoing investigation into the kidnapping claims. The next hearing in this crucial case has been scheduled for December 3.

Controversial Election Day Events Unfold

The controversy stems from events that occurred on August 14 during the Nainital zila panchayat chairperson and vice-chairperson elections. According to reports, the five panchayat members were allegedly taken away just before the voting process began. The High Court took suo motu cognizance of the matter after a video capturing these events began circulating widely.

While all five members have since been located safely, the case has taken another twist with some officials suggesting that the kidnapping might have been staged. This development adds complexity to an already contentious situation that has drawn judicial scrutiny.

Separate Petition Alleges Ballot Tampering

In a related development that further clouds the election's credibility, block development committee member Poonam Bisht has filed a separate petition highlighting another serious irregularity. Her petition claims that during the same election, a ballot paper was declared invalid after the number "1" was overwritten as "2".

Based on this alleged manipulation, Bisht has sought a re-election specifically for the chairperson's post. The court has taken cognizance of this plea as well and is hearing it as part of the public interest litigation, indicating the judiciary's comprehensive approach to addressing all election-related concerns.
