Haryana Commission Mandates Complete Development Before Plot Auctions
The Haryana Right to Service Commission has issued a clear directive. All essential development works must be fully completed before any plot goes up for e-auction. This ruling came during a hearing on the status of development works in Faridabad.
Key Ruling on Plot Allotment Process
A spokesperson for the commission stated the position firmly. Auction and offer of possession for plots should only happen after development works are finished. The commission's order observed a critical point. All basic amenities must be available on plots included in the e-auction. This enables allottees to begin construction work without delay.
In the specific case heard, a problem emerged. Possession was proposed along with an allotment letter issued on November 24, 2023. However, certain development works at the site remained incomplete. This created a situation where allottees could not proceed as expected.
Strict Adherence to Rules and Interest Payments
The commission highlighted Condition No. 5 of the standard allotment letter. It states that interest becomes payable if possession is not offered within 30 days. The commission emphasized that this rule must be implemented strictly.
As a public development authority, the Haryana Shehri Vikas Pradhikaran (HSVP) has a responsibility. The commission stated HSVP should adopt an automatic and time-bound process for interest payments in such cases. This would prevent allottees from being forced to approach forums unnecessarily.
The commission reinforced its stance by referring to the Punjab and Haryana High Court. Observations from October 16, 2025, were cited. The high court emphasized strict adherence to statutory objectives and prescribed procedures.
Compensation Awarded and Future Directives
The commission noted that in earlier similar cases, directions were issued. These directed granting due benefits to affected allottees as per the rules. In this present case, the commission held that under the Act's provisions, compensation up to Rs 5,000 can be awarded.
Accordingly, the commission exercised its powers under Section 17(1)(h) of the Haryana Right to Service Act, 2014. It directed that compensation of Rs 5,000 be paid to the complainant. HSVP must pay this amount within 15 days.
The commission further directed that the compensation amount shall be paid initially by the authority. Further action can be taken after fixing responsibility as per the rules.
Procedural Improvements Sought
A crucial future directive was also issued. The commission stated that no plot shall be included in the auction process without ensuring completion of development works. This is to prevent similar issues from recurring.
For a comprehensive review and to ensure procedural improvements, the commission sought specific documents. It requested the original noting sheets of the concerned file from the Chief Administrator of HSVP. It also asked for details of officers associated with auction, allotment, and development works from the Estate Officer in Faridabad.
This ruling aims to streamline the plot allotment process. It prioritizes the convenience and rights of citizens, ensuring they receive fully developed plots as promised.
