Punjab Information Commission Slaps Rs 25,000 Fine on Ludhiana Official for RTI Defiance
The Punjab State Information Commission has taken strong action against a block development and panchayat officer in Ludhiana, uncovering severe operational failures in a Right to Information (RTI) case. The commission's bench, led by State Information Commissioner Harpreet Singh Sandhu, has imposed a substantial penalty of Rs 25,000 and issued bailable warrants, highlighting a pattern of neglect and intentional non-compliance.
Chronic Delays and Absenteeism in RTI Proceedings
In a detailed order, the commission noted that the public information officer (PIO) failed to provide information sought under the RTI Act, 2005, for over 30 months, despite multiple hearings and explicit directions. The officer, serving as the block development and panchayat officer for Block II in Ludhiana, repeatedly absented himself from commission proceedings, including the latest hearing on March 24 and several past dates.
"The PIO appeared to be unmindful and ignored orders issued by the bench in successive hearings, thereby defying them," the commission observed. This behavior reflected a blatant disregard for the statutory institution's authority and its mandate to uphold transparency.
Wilful Defiance and Legal Consequences
The commission emphasized that despite being served a show-cause notice, the PIO neither appeared before it nor furnished the required information to the appellant. From these facts, it concluded that the respondent wilfully and intentionally defied its orders, constituting a gross violation of the RTI Act, 2005.
Citing a Supreme Court judgment, the commission underscored that such officers must be held accountable, as failure to discharge duties under the RTI Act could lead to serious repercussions. It held that the PIO, without any reasonable cause, malafidely delayed the information, rendering himself liable to punishment under the Act.
Penalty and Bailable Warrants Issued
Taking a serious view of the matter, the commission imposed a penalty of Rs 25,000 on the PIO, to be deducted from his salary and deposited into the state treasury. It noted that the case exemplified grave negligence and a lack of respect for statutory institutions.
"After going through the case file, it emerges that a grave negligence has been made on the part of the PIO by not complying with various orders passed by the bench. Further, it also transpires that the PIO has no respect for the statutory institution," reads Commissioner Sandhu's order.
In an escalated measure, the commission issued bailable warrants against the PIO, directing him to appear before it on May 26 with all relevant records. The warrants are to be served through the Commissioner of Police in Ludhiana, ensuring enforcement of the order.
Systemic Concerns and Call for Accountability
The commission's actions underscore broader systemic issues regarding compliance with transparency laws in Punjab. It stressed the imperative for accountability in the discharge of duties under the RTI framework, warning that such lapses undermine public trust and the effectiveness of governance mechanisms.
By holding the officer guilty of default and denying any relief, the commission sent a clear message about the consequences of defying RTI mandates, aiming to deter similar misconduct in the future.
