The Allahabad High Court on Thursday sought the Uttar Pradesh government's response on a petition challenging the order by the Inspector General of the Anti-Terrorist Squad (ATS) directing an inquiry into the running of madrasas in the state due to allegations of foreign funding.
Petition Filed by Madrasa Teachers Association
The petition, filed by the association of teachers of UP madrasas, challenges the probe order on the ground that there was no evidence of foreign funding for these madrasas. The teachers' body argued that the directive was issued without any substantial proof or prior investigation.
Background of the Inquiry Order
On December 9 last year, the IG (ATS) directed the Anti-Terrorism Squad to conduct an inquiry into the operations and funding of madrasas across Uttar Pradesh. The move was based on suspicions of foreign funding that could potentially be misused for unlawful activities.
During the hearing, the state government's counsel submitted that the writ petition was premature as only a direction for an inquiry had been given, and no conclusive findings had been reached. The bench, comprising Justice Arindam Sinha and Justice Satya Veer Singh, noted the submissions and set May 4 as the next date for hearing.
The court's decision to seek a response from the state government indicates a thorough judicial review of the matter. The petitioners have expressed confidence that the inquiry will be quashed due to lack of evidence. Meanwhile, the state government maintains that the inquiry is a routine administrative measure to ensure transparency and security.
This case has drawn significant attention as it involves the regulation of religious educational institutions and concerns over foreign funding. The outcome of the next hearing will be closely watched by various stakeholders.
